CONDITIONS OF CARRIAGE

1.1 New Zealand Mail Limited, "New Zealand Mail" is a registered postal operator in accordance with the Postal Services Act 1998.

1.2 New Zealand Mail for the purposes of the provision of its services has an Access Agreement with New Zealand Post for the delivery of its Postal Products, therefore the terms and conditions of the "Postal Services Act 1998" and the conditions of the "New Zealand Post Public Contract" outlined below, govern and apply to all services provided by New Zealand Mail

1.3 New Zealand Mail Limited Obligations

A New Zealand Mail Limited reserves the right to return to sender mail that is in breach of our dimensions or weight limits.
B New Zealand Mail Limited will accept all items for delivery if they meet the products criteria defined as Postal Articles.

1.4 Reseller and/or Sender Obligations

The reseller and/or sender of a Postal Article expressly agree:

A All items must bear the correct postage denomination for the service provided.
B To make available and understood the Terms and Conditions set out herein.
C To provide legible addresses on all Postal Articles and include return addresses on all mail.
D Not to send or allow to be sent any items that are listed in the IATA Dangerous Goods Regulations or do not comply with 1.1.5 and 1.1.6 of these terms and conditions.

1.5 THE NEW ZEALAND POST PUBLIC CONTRACT

Delivery of Postal and Courier Items

We, New Zealand Post Limited will use reasonable care and skill to provide our services to you. You agree to pay us the full price for all of our services, as advertised by New Zealand Post from time to time. We will deliver postal items, correctly addressed to addresses within our delivery network, which comply with the requirements set out in our Postal Users Guide.

You agree not to give us for delivery any item which is or contains:

  • Illegal, explosive, dangerous or is destructive to send.
  • Which are inadequately packaged, or capable, as packed, of causing injury, or damage to property
  • Contains cash.

Unless we consent in writing, you agree not to give us for delivery any item which is:

  • fragile, perishable or high risk (including any travellers cheque, stamp, voucher, deed, negotiable
  • instrument (including any bearer security, bill of exchange, or uncrossed cheque), bond or share, credit or bank card, bullion, precious metal or stone, jewellery, watch, any collectible or antique or any painting, sculpture or other work of art); or
  • A postal item with a value of over $250.

If you give us for delivery any postal or courier item referred to above, or in any other way you do not comply with the Postal Users Guide:

  • We and our employees and agents are not liable to pay any compensation to you for any loss or damage to, or delay in delivery of, that item; and
  • You agree to pay us for any resulting liability, costs, damage or loss of any kind.
  • Subject to the conditions set out in our Postal Users Guide, we limit our liability to you for loss or damage to, or any delay in the delivery of any item up to a maximum of:
  • Except as set out above and detailed further in the New Zealand Post Postal Users Guide and subject to the Consumer Guarantees Act 1993 (where applicable), we have no liability to you for any direct or indirect loss, damage, cost or delay however it arises (including as a result of intentional acts or negligence by us).
  • Is illegal, explosive, dangerous or destructive to send.
  • Is inadequately packaged, or contains anything that is capable, as packed, of causing injury, or damage to property.
  • Contains cash.
  • Is fragile, perishable or high risk (including any travellers cheque, stamp, voucher, deed, negotiable instrument (including any bearer security, bill of exchange, or uncrossed cheque), bond or share, credit or bank card, bullion, precious metal or stone, jewellery, watch, any collectible or antique or any painting, sculpture or other work of art); or
  • A Courier item with a value of over $ 1,500 If you give us for delivery any courier item referred to above, or in any other way you do not comply with the terms set out on our website www.courierpost.co.nz
  • You Understand that we and our employees and agents are not liable to pay any compensation to you for any loss or damage to that item and
  • You agree to pay us for any resulting liability, costs, damage or loss of any kind.

Subject to the conditions set out on our website, we limit our liability to you for loss or damage to any courier item up to a maximum of $ 1,500 Except as set out above and subject to the Consumer Guarantees Act 1993 (where applicable), we have no liability to you for any direct or indirect loss, damage, cost or delay however it arises (including as a result of intentional acts or negligence by us). You agree that, where you acquire goods or services from us for the purpose of your business, the provisions of the Consumer Guarantees Act 1993 which would otherwise apply to the supply by us of any of our goods or services to you, do not apply. EasyTrak can be used to send items within New Zealand only and has a target delivery of the next working day. Delivery targets are guides only and we do not guarantee that your item will reach its destination within the delivery target.
